GENERAL TERMS AND CONDITIONS FOR THE HIRING OF TOURIST SERVICES
Welcome to Explore Tierra del Fuego.
This document constitutes a contract between"Explore Tierra del Fuego"(hereinafter, "the Agency"), with CUIT 20-34988592-2, located at Camino del Valle 12, Ushuaia, Tierra del Fuego, and the client (hereinafter, "the Passenger" or "the User") who hires the services through the website.booking.exploretierradelfuego.tur.ar.
The hiring of any of our services implies knowledge and full acceptance of these general conditions.
1. OBJECT OF THE CONTRACT
The Agency acts as an intermediary between the Passenger and the final providers of tourist services (such as transporters, guides, restaurants, etc.), or as the direct organizer of excursions, as specified in the description of each service. This contract is governed by these conditions, the Consumer Defense Law No. 24.240, the Civil and Commercial Code of the Nation, and other applicable regulations.
2. RESERVATION REQUESTS AND PAYMENTS
2.1.The request for a reservation is initiated through the website. Sending a request does not imply confirmation of the service.
2.2.All amounts paid before the final confirmation are received as a reservation. The final confirmation of the services and their prices will occur with the issuance of the invoice and the corresponding voucher(s).
2.3.The balance of the price must be paid within the stipulated time at the time of the reservation. Otherwise, the Agency reserves the right to cancel the reservation without prior notice, applying the cancellation policies detailed in clause 4.
3. PRICES AND SERVICES INCLUDED / NOT INCLUDED
3.1. The prices INCLUDE:
All services that are expressly detailed in the description of the excursion published on the website and in the confirmation voucher, including applicable taxes. This may include:
- Transportation to and from the specified meeting points.
- Professional guide service.
- Meal plan, if explicitly stated (clarifying whether it includes drinks or not).
- Entry tickets or access tickets, if specified.
3.2. The prices DO NOT INCLUDE:
- Services not specified in the description of the excursion.
- Tips, unspecified drinks, meals on the way (unless stated otherwise).
- Entry to Tierra del Fuego National Park, unless its inclusion is expressly stated.
- Any personal expenses of the Passenger.
- Costs arising from modifications or cancellations of flights or other transport not contracted through the Agency.
4. CANCELLATION AND REFUND POLICY (BY THE PASSENGER)
The Passenger may cancel the contracted services at any time. The refund will be subject to the following conditions and penalties, calculated on the total price of the contracted service:

Note:Some services provided by third parties may have stricter cancellation policies. In such cases, the final provider's policies will prevail, which will be communicated to the Passenger before confirming the reservation.
5. CHANGES OR CANCELLATIONS (BY THE AGENCY)
5.1.The Agency reserves the right to change the itinerary, schedules, or contracted services due to force majeure or unforeseen circumstances, such as adverse weather conditions that jeopardize the safety of passengers, or for unavoidable operational reasons.
5.2.In the event of a significant change, alternatives will be offered to the Passenger. If the Passenger does not accept them, a refund of the amounts paid for the services not rendered will be processed.
5.3.The Agency may cancel any excursion when a minimum number of participants has not been reached, if required for its operation. In this case, the Passenger will be notified at least 24 hours in advance and a full refund of the amount paid will be processed, without this implying any right to compensation on the part of the Passenger.
6. LIABILITY
The Agency expressly states that it acts as an intermediary in the reservation of services, and its responsibility is limited to the management of such intermediation. It is not responsible for the total or partial non-fulfillment by the final service providers, nor for damages, injuries, delays, or any other irregularities that may occur during the execution of the same, unless there has been fault or negligence on the part of the Agency. The Agency is not responsible for the loss or damage of luggage or other personal effects of the Passenger.
7. DOCUMENTATION AND HEALTH STATUS
7.1.It is the sole responsibility of the Passenger to have the necessary and valid personal documentation to carry out the excursions (DNI for Argentine residents, Passport for foreigners).
7.2.For trips with minors under 18 years of age, it is the responsibility of the accompanying adults to comply with all current regulations of the National Directorate of Migrations and other authorities.
7.3.The Passenger declares to be in good physical and mental health, compatible with the activity to be performed. For excursions that involve significant physical effort (trekking, etc.), the Passenger assumes the inherent risks of the activity. The Agency or the final provider may prevent the participation of any person whose physical condition or behavior puts their own safety or that of the group at risk.
8. RIGHT OF WITHDRAWAL (BUTTON OF REGRET)
In accordance with theArticle 34 of Law No. 24.240and theArticle 1110 of the Civil and Commercial Code, the Passenger has the irrevocable right to revoke the acceptance of the purchase made by electronic means withinTEN (10) calendar daysfrom the date of the contract's celebration. To exercise this right, the Passenger must notify the Agency by a reliable means. Any costs that may arise from the return process will be borne by the Agency.
9. PERSONAL DATA PROTECTION
By contracting our services, the User provides personal data to the Agency. The processing of such data is governed by our Privacy Policy and in compliance with theLaw No. 25.326 on Personal Data Protection. The holder of personal data has the right to exercise the right of access, rectification, and deletion of the same free of charge. The Agency for Access to Public Information is the control body of Law No. 25,326.
10. JURISDICTION AND APPLICABLE LAW
For any dispute that may arise from this contract, the parties submit to the jurisdiction of theOrdinary Courts of the city of Ushuaia, Province of Tierra del Fuego, Antarctica and South Atlantic Islands, waiving any other venue or jurisdiction that may correspond to them. The applicable law will be that of the Argentine Republic.
